ONLINE SHOPPING TERMS AND CONDITIONS

 

InkaStyl online store is accessible at inkastyl.eu, the store is owned by: PPHU InkaStyl Małgorzata Kozłowska, with its seat in Głosków, ul.Radnych 5, registered in the register of companies maintained by the Piaseczno Town and Commune Mayor, under the number 19174, Tax ID No. 123-080-06-73, REGON No. 141599370.

Terms and definitions:

Store – online store available at http://www.inkastyl.eu, selling goods on the Internet;
Working days – all days of the week from Monday to Friday, excluding public holidays;
Order processing time – time needed for the store to compile and release all the items ordered to the carrier which delivers them to the customer in a selected mode;
Customer – natural or legal person buying goods at the store, being a registered user of the store;
Customer account – database containing customer data used for processing orders, purchase history, customer’s shopping preferences, information on payments and overpayments;
Regular transfer – payment made by the customer using internet or regular bank account or at a post office;
Electronic transfer – payment made by the customer using online bank account via PayPal system or other online payment systems.

I. Acceptance and processing of orders.

  1. The store sells goods and services on the Internet. Information on the goods and services is available at www.inkastyl.eu

  2. Orders at the store can be placed by a natural person with full or limited legal capacity as well as a legal person.

  3. Orders can be placed online at www.inkastyl.eu, 7 days a week, 24 hours a day.

  4. The customer, by placing an order, submits an offer to conclude a sales agreement for the goods or services ordered with the store. The store sends an e-mail with order confirmation which is a statement of acceptance of the abovementioned offer. In case of orders paid by COD (cash on delivery) placed by a newly registered customer, the customer receives an e-mail to confirm the order placed. The store has the right to request the customer to confirm the order also in case of future purchases.

  5. To place an order the customer shall:

    1. select the goods or services to be ordered,

    2. select the method of delivery, provide shipping address and billing address (the addresses may differ),

    3. select the method of payment.

  6. The maximum number of items of the same product in one order may not exceed 15 items.

  7. If part of the items ordered is not available in stock, at the suppliers or for other reasons which make the delivery impossible within the specified time (e.g. delay of delivery at the supplier's fault), the customer shall be informed about the status of the order and decides about the mode of delivery. The customer may choose the following options:

    1. partial delivery – if the customer chooses this option the delivery will include only the items available in stock, the store shall be released from the obligation to deliver unavailable items,

    2. cancellation of the whole order – if the customer chooses this option the store shall be released from the obligation to deliver the order.

If the customer has already paid for the order, the store shall return the amount paid within 7 (seven) working days from the cancellation of the order in part or whole according to the procedure described in Chapter VIII Refund of overpayments.

  1. If a product is currently unavailable in stock, at the suppliers or for other reasons which makes the delivery impossible, the store has the right to withdraw from the agreement within 30 (thirty) days from the date of its conclusion. If the customer has already paid for the order, the amount paid shall be returned within 7 days from the day when the store informed the customer about the withdrawal from the agreement (the notification shall be sent to the client’s e-mail address) according to the procedure described in Chapter VIII. Refund of overpayments.

  2. Special offers and clearance sales apply only to a limited number of products. The orders shall be processed in the order of placement while stocks last at the store or the suppliers.

II. Changes in orders.

  1. The customer may change or cancel his/her order until it is ready for dispatch. The changes can be made by contacting the Customer Service using the contact form available at the website or by telephone.

  2. Changes communicated in other way than in the contact form shall be accepted only upon confirmation of customer's identity. Modifications concerning: the customer's address, shipping address and requests for the recovery of funds shall be accepted only by means of the contact form available in Help section on logging onto the customer account.

III. Prices of goods.

  1. All prices of goods on the store website:

    1. are given in Polish currency PLN,

    2. include VAT,

    3. do not include any customs duties,

    4. do not include any shipping costs.

  2. The price of every product is binding at the moment of placing an order.

  3. The store reserves the right to change the prices of goods, carry out or cancel promotional or sales campaigns and make changes thereto. The abovementioned right does not affect the prices of goods ordered prior to the date of entry into force of the price change, changes to the promotional or sales campaign terms and conditions.

  4. Special offers cannot be combined unless the terms and conditions state otherwise.

  5. The delivery costs are included in the order summary. The goods are delivered in the mode selected by the customer when placing the order. The current information on the costs of delivery is available on the webpage Shopping, section Costs of delivery.

IV. Order processing time.

  1. The product page contains information about the expected time to prepare the product for shipment. It is the time from the acceptance of an order to the release of package to the carrier which delivers the goods to the customer. Only weekdays are taken into consideration. The orders for the products with different processing time is ready for dispatch when all the items ordered have been complied. The date of dispatch is determined on the basis of the product with the longest processing time.

  2. In Poland goods may be delivered, as chosen by the customer, either by Polish Post or by the courier company “Siódemka” to the address provided by the customer.

  3. Within the European Union goods may be delivered by Polish Post only.

  4. Outside the European Union goods may be delivered by Polish Post only.

  5. Not all of the methods of delivery are available for every product.

  6. The customer, on receiving the goods, shall check the condition of the package. If the packaging is damaged the customer, in the presence of the courier or postal worker, shall complete a damage report. The damage report shall be sent to the store to facilitate the complaint handling procedure.

V. Methods of payment. Beginning of the order processing.

  1. The customer may chose the following methods of payment for the goods ordered and delivered in the territory of Poland:

    1. cash on delivery. The order processing begins upon completion of the order placement procedure,

    2. wire transfer, electronic transfer, payment card (Visa, Visa Electron, MasterCard, Maestro, MC Electronic) using one of the accepted electronic payment systems (in case of payment by payment card the amount is chargeable on issue of the invoice, in exceptional cases, when the processing time is longer than 24 days, the amount is chargeable on the 24th day from the placement of an order) and online payment service ePrzelewy. The order processing begins when the store receives the confirmation that the payment has been authorized, in case of a wire transfer – after receipt of payment on the store’s account.

  2. Orders with delivery outside the territory of Poland may only be paid for by payment card (Visa, Visa Electron, MasterCard, Maestro, MC Electronic) using one of the accepted electronic payment systems and online payment service ePrzelewy. The order processing begins when the store receives the confirmation that the payment has been authorized.

  3. The customer may pay for the order with InkaStyl gift voucher. The voucher cannot be exchanged for cash in part or whole. Detailed information about shopping with gift vouchers is provided in the Terms and Conditions of Using Gift Vouchers.

  4. Not all of the methods of payment are available for every product.

  5. The store reserves the right to disable the method of payment “cash on delivery” in case of customers who did not collect previous order by cash on delivery, irrespective of the mode of delivery. The customer may again use the option "cash on delivery" after having collected and paid for an order using other option.

VI. Complaints.

  1. The products may be covered by the manufacturer’s or distributor’s guarantee. Detailed guarantee conditions and its duration are provided in the guarantee card issued by the guarantor.

  2. If the product has a defect, the customer may use the right to claim compensation for non-conformity of the product with the agreement. If the product is non-compliant with the agreement the customer has the right to file a complaint. The complaint shall be filed within 2 months from the delivery of goods, provided that the customer informed the store about the defect no later than within 10 (ten) days from the date of delivery. In this case the customer may send back the product by standard postal service to the store address: PPHU InkaStyl Małgorzata Kozłowska ul. Radnych 5, 05-503 Głosków. The customer shall attach a Complaintform.

  3. The store does not accept products sent by COD.

  4. The store shall resolve the matter within 14 days from the date of receipt of the defective product and inform the customer about further procedure. If the complaint has been accepted, the defective product shall be repaired or replaced with an equivalent one. If this is not possible (e.g. the product has run out of stock) the store shall return the amount paid for the product or offer a different one available in stock. The costs of sending back the product (standard postal service) shall be returned upon acceptance of the complaint according to the procedure described in Chapter VIII. Refund of overpayments.

  5. The store will not be held responsible for any difference in appearance between the product delivered and those presented on the website, which may result from different monitor settings (parameters).

 

VII. The right of withdrawal.

 

1. According to the Act of 2 March 2000 on protection of consumer rights and liability for damage caused by a dangerous product, the customer being a natural person may return the goods purchased for private purposes without stating the reason within 10 days from the date of receipt of the delivery.

2. The customer shall submit a statement of withdrawal from the agreement and return the product in its original state, without any traces of use.

3. The return of product in case of withdrawal from the agreement is possible if the product has not been used or damaged in any way. The product shall be complete (with all hangers and labels, original packaging). The products secured against opening shall not be returned if the film or protective items are removed, original packaging is damaged (the packaging may only be removed to check the condition of the product). Cosmetic products and other goods which for sanitary reasons should be contained in original packaging shall be returned in an intact packaging.

4. The product shall be sent back along with the Replacement form to the address: PPHU InkaStyl Małgorzata Kozłowska – Returns and Complaints Department, ul. Radnych 5, 05-503 Głosków.

5. The store does not accept products sent by COD. The costs of sending back the product are not recoverable.

6. The store shall return the amount paid within 7 (seven) working days, according to the procedure described in Chapter VIII. Refund of overpayments.

VIII. Refund of overpayments.

  1. If the store is obliged to return the amount paid by the customer to the store's account, the return shall be effected within 7 working days.

  2. If the customer paid for the goods by electronic transfer the amount shall be returned to the bank account from which the payment was made. In case of payments with a payment card, the return amount shall be credited to the card.

  3. In case of regular transfer, COD or if the store is unable to identify the bank account from which the payment was made, the return amount shall be credited to the customer's account indicated in the abovementioned form.

  4. The overpayment shall be credited to the customer's bank account only on the customer's request. The request shall be submitted using the contact form available on the Help webpage, on logging onto the customer account. The store reserves the right to verify the identity of the customer who has requested the repayment.

  5. The store does not refund the overpayments by postal service.

  6. The store shall not be held responsible for non-repayment of the amount due or delay of repayment, if the customer, despite the request submitted to his/her e-mail address, has not indicated the bank account to which the payment shall be made or has not provided the store with all information necessary to make the payment.

  7. The store shall not be held responsible for non-repayment of the amount due or delay of repayment, if the customer provided incorrect personal data (name, surname, address) or an incorrect account number.

 

IX. Personal data.

  1. By placing an order the customer agrees to place his/her personal data in the database of InkaStyl online store and process them for the purposes of this agreement.

  2. The provision of personal data is voluntary, however the consent to use personal data is required to process the order.

  3. The customer shall be held responsible for submitting false personal data.

  4. According to the personal data protection act of 29.08.1997 (OJ No. 101 of 2002, p. 926 with further amendments) the personal data are protected against unauthorized access.

  5. The customer's personal data shall be processed for the purposes of sending information about new products, special offers and services offered by the store only if the customer consents thereto.

  6. The store customers have the right to view and correct their personal data and request their deletion.

 

X. Final provisions.

  1. The sales agreement is concluded between the customer and PPHU InkaStyl Małgorzata Kozłowska.

  2. The products presented on the store’s web pages do not constitute an offer within the meaning of the Civil Code. Information on the products presented on the website does not mean that the product is available at the store or suppliers warehouse.

  3. The store shall not be held responsible if the e-mail servers reject correspondence sent to the e-mail address of the customer, and for deletion and rejection of e-mails by applications installed on the customer’s computer.

  4. The store shall not be held responsible for mistakes in handling the order or other customer’s requests as a result of submitting incorrect information by the customer.

  5. The store shall not be held responsible for transactions made by unauthorized third parties who gained access to the customer's account as a result of improper handling of login and password to the account.

  6. Any arguments arising from the sales agreement shall be resolved by the court applicable to the defendant or the place of performance of the agreement.

  7. To all matters not regulated in these Terms and Conditions the provisions of Polish law shall apply, in particular the provisions of the Civil Code, act on specific terms and conditions of consumer sale and amendments to the Civil Code (OJ No. 141 of 2002, p. 1176, with further amendments) and the act on protection of consumer rights and liability for damage caused by a dangerous product (OJ No. 22 of 2000, p. 271 with further amendments).

  8. These Terms and Conditions shall apply from 24.03.2012.

  9. The store reserves the right to change the Terms and Conditions. Any changes to the Terms and Conditions shall enter into force on the date specified by the store, within no less than 7 days from the publication on www.inkastyl.eu.

  10. The orders placed prior to the date of entry into force of the changes to the Terms and Conditions shall be fulfilled according to the provisions applicable on the day of placing the order.
